Terms, refunds and cancellations
Last updated 24 October 2026
These terms cover work and subscriptions bought from Dylan Leigh Barber (ABN 75 258 494 349), a sole trader in Bunbury, Western Australia ("I", "me"). By booking an audit, accepting a quote or subscribing, you agree to them. A signed quote or agreement for a specific job takes priority over these terms where they differ.
Nothing in these terms limits your rights under the Australian Consumer Law. If something I supply has a major failure, you're entitled to a refund or replacement, and to compensation for other reasonably foreseeable loss.
Prices and payment
- All prices are in Australian dollars and include GST.
- I don't add card surcharges.
- You can pay by card through Stripe or by bank transfer. Card details are handled by Stripe and never stored by me.
- Invoices are due 14 days from issue unless the quote says otherwise.
Audits
- An audit is $490 and includes half a day on site plus a written report.
- If you go ahead with a build within 60 days, the audit fee comes off its price.
- Rescheduling is free with at least 24 hours' notice.
- Cancelling more than 48 hours before the visit gets a full refund. Inside 48 hours, I keep half the fee to cover the booked time.
Builds
- Each build has a written, fixed-price quote, and I don't start until you've accepted it. Any deposit is stated on the quote. The balance is invoiced on delivery.
- If you ask for changes outside the quote, I'll quote them separately first.
- For 30 days after delivery, I fix bugs in what I built at no charge.
- If I can't deliver part of what was quoted, you won't pay for that part, and I'll refund any amount you've already paid for it.
- If you cancel a build partway through, you pay for the work completed so far and I refund the rest of any deposit.
Who owns what I build
- Once it's paid for, you get a permanent, royalty-free right to use, change and run your copy of the software, for as long as you like, wherever you like.
- I keep ownership of the general-purpose parts, such as common tools and building blocks, so I can reuse them for other clients. This keeps prices down.
- If you want exclusive ownership of the whole build, ask and I'll quote for it.
Hosting plans and Menu Kit (subscriptions)
- Subscriptions are billed monthly in advance. They renew automatically until you cancel.
- You can cancel at any time using the billing link in any receipt, or by emailing support@dlbarber.dev. Your service runs until the end of the period you've paid for, and you won't be charged again.
- I don't refund part-months, except where the Australian Consumer Law requires it or the service was unavailable for a significant part of the month because of me.
- When you cancel, I'll give you a copy of your data and, for hosted builds, everything you need to run the software yourself.
- I'll give at least 30 days' notice of any price change. You can cancel before it takes effect.
Menu Kit and allergens
Menu Kit shows dietary and allergen labels only from information you enter and confirm. You remain responsible for the accuracy of your menu and allergen information. Check it before publishing.
Refunds
To ask for a refund, email accounts@dlbarber.dev with your invoice number and what went wrong. I'll reply within two business days. Approved refunds go back to the original payment method, usually within 5 to 10 business days.
Liability
To the extent the law allows, my total liability for any job or subscription is limited to the amount you paid me for it in the 12 months before the claim. I'm not liable for indirect losses, such as lost profits. None of this applies where the Australian Consumer Law says it can't be excluded.
Who you're dealing with
I use an AI assistant to help answer emails and manage quotes and invoices. It always identifies itself as "Dylan's Assistant (AI)". Refunds, discounts and anything unusual are approved by me personally. Just ask if you'd rather deal with me directly.
Disputes and governing law
If something goes wrong, please email me first. Most things can be fixed quickly. These terms are governed by the law of Western Australia.
